Terms and Conditions

1. GENERAL

Bittern Books, a trading name of Unilake Ltd., is prepared to supply books, maps and other goods on the basis only of its terms and conditions as set out below.

2. PRICES

2.1 Unless otherwise agreed by Bittern Books in writing, the price for goods that are in stock at the time of order shall be the price set out on this website when an order is placed, or for orders taken by other means, in the Sales Order confirmation which will be sent to the Customer’s email address prior to dispatch of the order, plus the cost of delivery calculated in accordance with Bittern Books delivery policy, plus any additional value added tax and other taxes or duties that may be applicable to the Goods.

2.2 The price of goods that are backordered are subject to change in the event that Bittern Books’ supplier changes its prices. In this case Bittern Books will notify the Customer of the change and the Customer may choose to cancel the order.

2.3 The price will be based on the publisher’s recommended retail price, or a lower suggested selling price where applicable, less any applicable discounts.

2.4 For trade customers an invoice setting out the price payable for the Goods dispatched will be sent to the Customer’s email address on dispatch, or if no email address has been provided, included with the goods or sent separately by second class post.

2.4 Prices and discounts published in Bittern Books’ catalogues, price lists, website and any other communications are subject to change without notice.

3. ORDERS AND DELIVERY

3.1 Bittern Books will accept orders by telephone, email, through our website or in person to our sales representative.

3.2 Shipment of orders is normally within two working days of acceptance of the order, except where goods are out of stock. Delivery will be by courier service or Royal Mail depending on the size of the package. Goods may be collected in person from Bittern Books premises by prior arrangement.

3.3 Goods out of stock at the time of order will be backordered and shipped as soon as they become available at no extra cost. Items ordered but not expected to be available within 30 days will be cancelled from the order and the customer notified.

3.4 Carriage on deliveries within the UK mainland will be paid by Bittern Books on all orders with a total value excluding carriage and taxes exceeding the Minimum Carriage Paid value. Carriage on all deliveries within the UK mainland for orders of less than the Minimum Carriage Paid value will be charged at approximate cost.  The Minimum Carriage Paid value will be clearly displayed on Bittern Books website and may change without notice.

4.PAYMENT

4.1 Payment for all orders must be made within 30 days of invoice date for all accounts unless other payment terms are specifically agreed. Thereafter (without prejudice to any remedies available to Bittern Books) interest on payments due will accrue at the rate of 2% per annum over the Bank of England base rate from time to time until payment in full is received from the Customer.

4.2 Notwithstanding the above, payment for all orders shall become due immediately in the event that the Customer is adjudged bankrupt or insolvent, has a receiver or administrator appointed over its assets or enters into any composition with its creditors.

4.3 Payment may be made by cheque, bank transfer, debit or credit card. Cash payments will be accepted by prior arrangement.

4.4 Customers without a credit account may purchase goods which are in stock by paying in advance by cheque, bank transfer, debit or credit card. A pro forma invoice will be issued on request.

5. IMPERFECT GOODS AND DAMAGES CLAIMS

Any products that are supplied in a damaged or imperfect state will be replaced, requested for return, or credited at the discretion of Bittern Books and this will represent the extent of Bittern Books liability for the same. In order to register a claim for imperfect, damaged products or shortages in your order, please contact us within five working days of the products being received.

6. LIABILITY

Notwithstanding the delivery times set out in these terms of business, whilst Bittern Books will use its reasonable endeavours to deliver orders as soon as possible it accepts no liability for late delivery. Bittern Books will not be liable for any indirect or consequential or loss of profit in respect of any order and its liability shall be limited to the amount of the relevant order at net invoice value.

7. RETENTION OF TITLE

7.1 The risk in all goods purchased by the Customer will pass to the Customer upon delivery. However, until full payment has been received by Bittern Books for all goods supplied by them to the Customer, such goods shall remain the property of Bittern Books.

7.2 If a Receiver or Administrator or Trustee in Bankruptcy is appointed over any of the Customer’s assets, or if for any reason payment of the total price of the goods is not made on the due date, Bittern Books shall have the right with or without notice at any time thereafter to retake possession of all or part of its goods and for such purpose authorised representatives of Bittern Books shall be entitled to enter upon any premises occupied or used by the Customer.

7.3 Notwithstanding the above, unless and until Bittern Books notifies the Customer to the contrary the Customer will be permitted to sell Bittern Books goods which have not been paid for to third parties in the normal course of business.

8. VARIATIONS AND HEADINGS

Bittern Books shall be entitled from time to time to make changes to these terms and conditions. Bittern Books website will always display the most recent version of these terms and conditions for customers to review. The headings in these terms and conditions are for convenience only

9. GOVERNING LAW

These terms and conditions of business shall be governed by English Law.
